The Philippine Law on Explosives (RA 9516) is a comprehensive legislation regulating the manufacture, distribution, sale, use, and possession of explosives. It aims to ensure public safety and prevent acts of terrorism and other crimes involving explosives.
The key provisions in the law are
SEC. 4-D. Types of Chemical/Accessories Covered. – The chemicals and accessories mentioned in the preceding Section shall exclusively refer to chlorates, nitrates, nitric acid and such other chemical and accessories that can be used for the manufacture of explosives and explosive ingredients.
SEC. 4-E. Record Transactions.– Any person or entity who intends to import, sell or possess the aforecited chemicals or accessories shall file an application with the chief of the PNP, stating therein the purpose for which the license and/or permit sought and such other information as may be required by the said officials. The concerned person or entity shall maintain a permanent record of all transactions entered into in relation with the aforecited chemicals or accessories, which documents shall be open to inspection by the appropriate authorities.
Strict Control of Explosive Precursors:
- Licensing Requirements: Importers/Local Chemical Companies must obtain necessary licenses and permits from the Philippine National Police (PNP) to import controlled chemicals and accessories.
- Detailed Documentation: Importers are required to provide detailed documentation about the imported goods, including their intended use and end-users.
- Customs Clearance: Customs authorities may conduct stricter inspections and require additional documentation to ensure compliance with RA 9516.
